What are the characteristics of construction labor subcontracting?

　　1. Labor subcontracting is an ancillary contract to the general contracting agreement and exists solely as a prerequisite tied to the construction project contract—without the construction project contract, there can be no labor subcontracting agreement.

The scope of labor subcontracting covers labor services within construction projects; therefore, a labor subcontracting contract is either a "labor-only" agreement (where the contractor provides labor but not materials) or a "labor-plus-supplies" arrangement (covering both labor and auxiliary materials). 3. The parties involved in labor subcontracting must be enterprises holding the appropriate qualifications. The project owner for labor subcontracting is typically the general contractor of the construction project—or, alternatively, the contractor under a specialized subcontract. Meanwhile, the labor contractor must also be a qualified labor service enterprise. Since the parties to the labor contract are businesses, the relationship established is a legal one between corporations; thus, a labor subcontracting contract is not considered an employment contract.

　　3. Labor subcontracting does not require the consent of the project owner. Labor subcontracting occurs exclusively between the general contractor and the labor contractor, focusing solely on the provision of construction labor services rather than specific work packages or sub-projects. As such, labor subcontracting establishes no direct legal relationship with the project owner. Therefore, when the general contractor or the specialized subcontractor assigns labor tasks, they are not required to obtain approval from either the owner or the general contractor.
